Lindsay Lohan was so pissed off over Pitbull’s reference to her name in his song “Give Me Everything” that she filed a lawsuit to recover damages for his unauthorized use of her name. The actual lyric he used said, “I got it locked up like Lindsay Lohan.”
A federal court Judge in New York has finally gotten around to entertaining Pitbull’s Motion to Dismiss and has ruled that Pitbull’s lyric is permissible under the First Amendment because it is considered a creative expression.
This motion has been pending for nearly a year and Pitbull’s attorney, Marcos Jimenez, said that he “wasn’t shocked” by the verdict and wished that Lindsay wouldn’t have filed the suit in the first place. He also said that today’s ruling will “further solidify the rights of artists to express themselves in song.”
Last year, Pitbull was able to get a $1,500.00 sanction imposed against Lilo’s attorney for plagiarizing part of her opposition to the Motion to Dismiss. The fact that the Motion was ultimately granted is just icing on the cake.
